The land is subject to an overage provision which is set out in the Transfer dated 13th February 2012. The Special Conditions have been updated and completion is conditional upon the Deed of Covenant and Deed of Release being agreed with the Beneficiary, the Buyer executing the Deed of Covenant and releasing this to the Seller and the Seller and the Receiver and Beneficiary entering into the Deed of Release. Completion will be the later of: 20 Business Days from the date of the Agreement and 2 Business Days after the above conditions have been satisfied or waived by the Seller or Receiver. Either party can terminate if the above conditions have not been satisfied by 40 Business Days from the date of the agreement.
