The property lies adjacent to Lot 16 and the property is part freehold part leasehold all as detailed in the Legal Pack. VAT is payable in addition to the purchase price. The SellerÁs solicitor has made an application to the Land Registry to: 1. Remove the lease dated 23.11.1935 for a term of 999 years from title GM823294; and 2. merge title number GM185311 and GM823294. The application is included in the auction pack. The Seller offers no warranty or guarantee that the Land Registry will complete either application and the successful buyer of the lot will not be entitled to delay completion on the basis that the lease dated 23.11.1935 remains on the title or that titles GM185311 and GM823294 have not been merged by completion. The seller shall not be required to continue with these applications post completion but may do so at its sole discretion and the buyer shall permit the seller to continue with these applications post completion if it so chooses. The Lot which the Seller is selling consists of two interests in the Property (1) a transfer of part of a Freehold interest registered under title GM823294 and (2) a Leasehold interest in the Property for a term of 999 years less 10 days under a lease dated 21 August 1950 made between (1) Taylors (Wigan) Limited and (2) United Newspapers Limited registered with title number GM185311. As the title pack indicates, the freehold interest in the Lot is also subject to a Head Lease dated 23 November 1935 made between (1) Wigan Football Club and (2) William Taylor for a term of 999 years which is unregistered but is noted on title GM823294 (ÄHead LeaseÃ). The identity of the of the tenant under the Head Lease is unknown to the Seller. The Seller has not paid rent under its leasehold interest to any third party and as owner of the freehold interest in title GM823294 has not collected rent as landlord. The Seller believes but does not warrant that the Head Lease and the Freehold interest in the lot were once in single ownership and as a result may have merged. The SellerÁs solicitor has written to the Land Registry in this regard × see email attached. However, the Seller is unable to confirm that the Head Lease has merged with the Freehold and gives no warranty or representation in this regard and no warranties or guarantees that the Land Registry will merge the Head Lease into the Freehold Title GM823294. Accordingly the Freehold interest in the Lot is offered subject to and with the benefit of the Head Lease but only to the extent that it still exists.
